Terms of Service

Effective Date: April 13, 2026 Operated by: RedSky Analytics LLC, an Illinois limited liability company. Applies to: askfutures.com and the AskFutures mobile application (collectively, the “Platform”).

1. Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Platform.

2. Description of Services

AskFutures provides subscription-based software tools that:

• Generate trading strategy code using artificial intelligence systems
• Backtest user-defined trading rules
• Analyze historical market data
• Provide simulated performance metrics and research outputs

The Platform is intended solely for research and informational purposes.

3. No Investment Advice; No Advisory Relationship

The Platform does not provide:

• Investment advice
• Trading recommendations
• Brokerage services
• Commodity trading advice
• Legal or tax advice

RedSky Analytics LLC is not registered as an investment adviser, broker-dealer, commodity trading advisor, or futures commission merchant. Nothing on the Platform creates a fiduciary, advisory, brokerage, or agency relationship. Users are solely responsible for their trading decisions.

4. Hypothetical Performance Disclosure

Backtest results are hypothetical and simulated. Hypothetical or simulated performance results have inherent limitations. Unlike actual trading results, simulated results do not represent real trading. Since trades have not been executed, results may under- or over-compensate for market factors such as liquidity, slippage, volatility, and execution delays. Simulated trading programs are designed with the benefit of hindsight. Past performance — whether actual or simulated — does not guarantee future results.

5. Data Resolution and Execution Modeling

Backtests are conducted using minute-level historical data, which is the highest data resolution currently available on the Platform. At present:

• Transaction costs are not automatically included
• Slippage is not automatically modeled

Unless explicitly stated otherwise, performance results reflect gross returns before commissions, fees, and execution costs. Live trading results may differ materially.

6. Use of Artificial Intelligence

The Platform utilizes automated systems, including large language models and agentic artificial intelligence systems, to generate trading strategy code and analytical outputs based on user-defined rules. These systems:

• Generate outputs probabilistically
• May produce incomplete, inaccurate, or unintended results
• May not fully reflect user intent

Although RedSky Analytics LLC implements grounding techniques, validation checks, and output review mechanisms designed to improve reliability and reduce errors, no representation or warranty is made that generated code or outputs will:

• Be error-free
• Fully match user requirements
• Be suitable for live trading

Users are solely responsible for reviewing, validating, and testing all generated outputs prior to use. RedSky Analytics LLC disclaims liability for losses resulting from reliance on AI-generated outputs.

7. User Inputs

Users may provide trading strategy rules, including but not limited to:

• Entry conditions
• Exit rules
• Risk management rules
• Profit targets
• Stop-loss levels
• Time-in-trade conditions

Users retain ownership of their strategy logic. By submitting strategy rules, users grant RedSky Analytics LLC a limited license to process and analyze such inputs solely to provide Platform functionality.

8. Subscription Terms

Free Trial

The Platform may offer a 5-day free trial. At the conclusion of the trial period, the subscription will automatically convert to a paid subscription unless canceled prior to expiration.

Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle unless canceled before renewal. By subscribing, you authorize RedSky Analytics LLC to charge your selected payment method on a recurring basis.

No Refund Policy

All subscription fees are non-refundable. No partial refunds will be provided for unused subscription periods. Users may cancel at any time; cancellation will take effect at the end of the current billing period.

9. Public Leaderboards and Marketing

The Platform may display hypothetical performance results publicly, including through leaderboards or marketing materials. Such results:

• Are hypothetical
• Are based on simulated backtests
• Do not represent actual trading accounts

10. Platform Integrity; Monitoring; Abuse Prevention

User interactions with the Platform may be monitored, logged, and reviewed to:

• Maintain system integrity
• Prevent abuse or misuse
• Protect proprietary systems and intellectual property
• Ensure compliance with these Terms

Users may not attempt to extract, reverse engineer, or manipulate the system to disclose proprietary information, prompts, configurations, or trade secrets. If RedSky Analytics LLC determines, in its sole discretion, that a user has violated these Terms, the Company may suspend or permanently terminate the account. If permanently terminated:

• Auto-renewal will be discontinued
• No refunds will be issued for payments already made

11. Limitation of Liability

To the fullest extent permitted by law, RedSky Analytics LLC shall not be liable for:

• Trading losses
• Lost profits
• Indirect or consequential damages
• Data inaccuracies
• Service interruptions

Total liability shall not exceed the total subscription fees paid during the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Platform is provided “as is” and “as available.” No warranties are made regarding:

• Accuracy of data
• Accuracy of AI outputs
• Suitability for live trading
• Uninterrupted service

13. Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in Illinois under the rules of the American Arbitration Association. You waive the right to trial by jury and participation in class actions. Arbitration shall be conducted on an individual basis only.

14. Governing Law

These Terms are governed by the laws of the State of Illinois.
